UCMJ
The Uniform Code of Military Justice. This is the law of the land for all members of the US military. Everything you can think of is covered in this set of documents. The UCMJ covers all members of the military as well as those uniformed members of the armed services not attached to the DOD. This includes the Coast Guards.
The code, UCMJ, 64 Stat. 109, 10 U.S.C. ch47, has 12 sub chapters and is then broken down into procedures and articles under those sub chapters. Crimes such as murder, rape, and robbery are covered as well as special areas unique to the military.
Military justice is different from that of civilian justice. Military justice does not follow the innocent until proven guilty as civilian justice.
Military justice closely follows the rules set in many European countries.
The forerunner of the UCMJ was the 69 Articles of War to govern the conduct of the Continental Army. The Congress is given the power to regular the actions of all land and sea forces of the US under Article I Sec 8 of the Constitution. In 1806 the 69 Articles of War were changed to 101 Articles of War.
The Articles of War were the justice system which the military operated under until 1951 when President Truman singed into law the UCMJ.
Just about everything that can be included in the UCMJ is covered. In the event there is something that is not covered, Article 134 is used. This is the general article. It is used to cover a few topics that are not directly covered under the UCMJ.
